Interpretation
Words with an initial capitalized letter have the meanings defined under the following conditions. The following definitions have the same meaning whether they are used in the singular or plural.

    Refers to: Republic of Armenia.

  • Terms & Conditions (also referred as "Terms", “Terms and Conditions“)
    Mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

  • Product (also reffered as “The Product”)
    Means the computer software and may include associated media, printed materials, and "online" or electronic documentation.

  • Device 
    Means any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Service 
    Refers to the Website: hst.aero

  • Content
    Combining two defenitions: "Product" and "Service".

  • You 
    Means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Content, as applicable.

Acknowledgment

These are the Terms & Conditions governing your use of this Content and the agreement between you and the Company. These Terms set out the rights and obligations of all users in relation to the use of the Service.

Your access to and use of the Content is subject to your consent and compliance with these Terms and Conditions. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Content, you agree to these Terms. If you do not agree with any part of these Terms and Conditions, then you cannot access the Service.

You declare that you are at least 16 years old. The Company does not allow anyone under the age of 16 to use the Content.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms & Conditions.

Upon termination, Your right to use the Content will cease immediately.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

Restrictions

Except as expressly set out in this Terms or as permitted by any local law, you undertake:

  • Not to copy The Product, except where such copying is incidental to normal use of The Product or where it is necessary for the purpose of back-up or operational security.

  • To only use The Product for personal entertainment purposes and not to use The Product for flight training purposes.

  • Not to rent, lease, sub-license, loan, translate, merge, adapt, vary, alter or modify, the whole or any part of The Product nor permit the Product or any part of it to be combined with, or become incorporated in, any other programs.

  • Not to provide, or otherwise make available, The Product in any form, in whole or in part (including, but not limited to, program listings, object and source program listings, object code and source code) to any person without our prior written consent.

  • Not to disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of The Product nor attempt to do any such thing; and not to modify, use, call GUIDs, reference, extract or in any way make use of the any software project be it freeware, donation ware or payware.

IPRs (Intellectual Property Rights)

You acknowledge that:

  • All intellectual property rights in and to the original created components of The Product (including but not limited to any images, photographs, animations, video, audio, music, and text incorporated into The Product), and any copies of The Product are owned by HST Simulations Ltd. or its third party suppliers;

  • You have no intellectual property rights in or to The Product other than the right to use The Product in accordance with the terms of this Terms;

  • All title and intellectual property rights in and to additional third party libraries and content accessed through use of The Product is the property of the respective content owner and this Terms grants you no rights to use such content.

Disputes Resolution

If You have any concern or dispute about the Content, You agree to first try to resolve the dispute informally by contacting the Company.

Disclaimer

By using the service, product, you agree that:

  • Content is provided “as is,” and we do not guarantee the functionality of the Content or a particular result from the use of Content.

  • Neither HST Simulations LLC, its members, managers, officers, employees, agents, nor its suppliers shall be liable to you for any loss of use, lost or inaccurate data, lost profits, failure of security mechanisms, interruption of business, delays or any direct, indirect, special, incidental, reliance or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict liability or otherwise, even if informed of the possibility of such damages in advance.

  • The extent permitted by law, HST Simulations LLC expressly disclaims any responsibility for the loss or damage, including personal injury or death, resulting from the use of Content.

  • To the maximum extent permitted by applicable law, The Company shall under no circumstances be liable for any special, incidental, consequential or consequential damages (including without limitation damages, damages, loss of business information, business interaction and any other damages) as a result of use or inability use of Content or the provision or need for support services, even if the HST Simulations LLC has been presented with the possibility of such damages.

  • Under no circumstances will HST Simulations LLC does not authorize you to use the Content in applications or systems in which failure of the Content to operate on a reasonable basis could result in physical injury, loss or danger to life. Any such use by you is solely at your own risk and you agree to protect HST Simulations LLC from any claim or loss arising out of such unauthorized use.

  • The above disclaimers do not exclude or in any way limit our liability to you if it would be illegal.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Content. Your use of the Application may also be subject to other local, state, national, or international laws.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
